BILA Seminar: English and Italian employment law: where are we heading?

  • LK Law LLP 33 Black Friars Lane London, England, EC4V 6EP United Kingdom (map)

Please join us for our latest seminar on Thursday 26 September 2024 at 6.30pm at the offices of LK Law LLP, 33 Black Friars Lane, London EC4V 6EP, on the subject of the direction of travel of English and Italian employment law. We will discuss, from a comparative angle, what's on the horizon for employers and employees in relation to issues such as the protection against unfair dismissal from day 1, flexible working and the right to disconnect. The seminar will be followed by a drinks reception.

Our speakers will be Mark Green, Barrister at 3 Paper Buildings (3PB), and Patrizio Bernardo, Partner and Head of the Employment Department at Delfino e Associati Willkie Farr and Gallagher LLP.

Mark is an employment law specialist and appears frequently for both claimants and respondents, dealing with claims in the Employment Tribunal, Employment Appeal Tribunal, Court of Appeal, High Court and County Court. He is consistently ranked in the Legal 500 and Chambers UK with clients praising him as a ‘skilled and highly competent barrister’, noting his ‘huge intellect’, ‘excellent tactical mind’ and 'quiet and unassuming confidence' that makes lay clients ‘feel at ease as soon as they meet him’ in addition to his 'excellent, pragmatic advice’.

Mark also has a media presence, following the high profile age discrimination case of Jolly v Royal Berkshire NHS Foundation Trust 3324869/2017, and several appearances on television, radio and in national newspapers, including discussing the case on the This Morning sofa.

He also has a niche practice focussing on the overlap between employment law and national security law, and has co-authored two chapters entitled 'Employment Law and National Security' and ‘National Security Vetting' in the ‘National Security: Law, Practice, and Procedure’ (OUP, 2024). He has been commissioned to write a practitioner’s text on age discrimination.

He was appointed to the Attorney General’s ‘A’ Panel in 2023, and regularly represents a number of government departments.

Patrizio provides out-of-court assistance and advice to domestic and foreign clients in the field of labour law, trade union law, social security law and agency law, in particular with regard to hiring and dismissal of executives, post-contractual non-competition agreements, collective dismissals and restructuring of companies both in performance and in bankruptcy proceedings, transfer of companies, management of remuneration policies (including cash incentive plans, stock option plans, etc.), consequences on subordinate employment relationships arising from extraordinary transactions, including in the context of complex insolvency proceedings (bankruptcy proceedings, arrangements with creditors, extraordinary administration), negotiation of second-level collective agreements, and drafting of agency agreements. He also provides assistance on labour issues in court on a wide range of employment issues, including procedures in the field of health and safety and accidents at work, at a number of courts in Italy, including before the Court of Cassation. Patrizio lectured at the University of Padua in comparative labour law from 1998 to 2011 and regularly works as a speaker at leading training companies and university institutes. He is the author of numerous publications in specialist journals in the sector.
